C&#8217;est un peu David qui porte plainte contre Goliath, alors qu&#8217;initialement c&#8217;\u00e9tait <a href=\"https:\/\/contrib.city\/index.php\/2020\/10\/15\/m-h-aubert-je-vais-porter-plainte-contre-foucault-pour-lui-mettre-du-plomb-dans-la-tete\/?highlight=plomb%20dans%20la%20t%C3%AAte\" target=\"_blank\" rel=\"noopener\">Goliath qui devait porter plainte contre David<\/a>.<\/p>\n<p class=\"western\" align=\"justify\">Une hypoth\u00e8se \u00e9merge. Prenons le cas o\u00f9 l&#8217;aide fonctionnelle serait valid\u00e9e, du fait que Mme Aubert ait utilis\u00e9 le conseil municipal de Jouy-en-Josas, organe local de la R\u00e9publique Fran\u00e7aise, pour accuser non seulement Contrib&#8217;City mais \u00e9galement, en son nom propre, son cr\u00e9ateur. Alors cela voudrait donc dire que tout \u00e9lu peut faire de fausses d\u00e9clarations \u00e0 une entit\u00e9 publique, et, dans le cas o\u00f9 un m\u00e9dia viendrait \u00e0 d\u00e9noncer de telles pratiques, cet \u00e9lu pourrait toujours se r\u00e9fugier derri\u00e8re la protection fonctionnelle, malgr\u00e9 le fait que sa d\u00e9claration est parfaitement d\u00e9tachable de son mandat public? On se retrouverait donc dans une situation o\u00f9 un simple citoyen, pour d\u00e9noncer des fautes de la part d&#8217;un \u00e9lu, devrait disposer de suffisamment de moyens financiers alors, qu&#8217;en face, l&#8217;\u00e9lu b\u00e9n\u00e9ficierait de moyens publics tr\u00e8s importants et que, m\u00eame en cas de jugement d\u00e9favorable pour lui, ce soit finalement les contribuables qui payent pour son action malhonn\u00eate. Est-ce bien l&#8217;esprit de notre d\u00e9mocratie, c&#8217;est-\u00e0-dire le pouvoir du peuple?
