{"id":8871,"date":"2022-10-14T12:18:40","date_gmt":"2022-10-14T10:18:40","guid":{"rendered":"https:\/\/contrib.city\/?p=8871"},"modified":"2022-10-17T11:55:07","modified_gmt":"2022-10-17T09:55:07","slug":"la-cour-dappel-de-versailles-renvoie-dos-a-dos-cc-et-marie-helene-aubert","status":"publish","type":"post","link":"https:\/\/contrib.city\/index.php\/2022\/10\/14\/la-cour-dappel-de-versailles-renvoie-dos-a-dos-cc-et-marie-helene-aubert\/","title":{"rendered":"La Cour d\u2019Appel de Versailles renvoie dos-\u00e0-dos CC et Marie-H\u00e9l\u00e8ne Aubert"},"content":{"rendered":"<p class=\"western\" style=\"text-align: justify;\" align=\"justify\">Dans son jugement du 20 septembre 2022, le tribunal versaillais de 2<sup>e<\/sup> instance a d\u00e9bout\u00e9 les deux parties : Contrib\u2019City, qui avait port\u00e9 plainte pour diffamation, et Marie-H\u00e9l\u00e8ne Aubert, maire de Jouy-en-Josas, vice-pr\u00e9sidente de la communaut\u00e9 d\u2019agglom\u00e9ration de Versailles-Grand Parc et premi\u00e8re vice-pr\u00e9sidente du Conseil d\u00e9partemental des Yvelines.<\/p>\n<p style=\"text-align: justify;\">Rappelons les points essentiels&nbsp;:<\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: medium;\">Le 4 juin 2020, Marie-H\u00e9l\u00e8ne Aubert avait \u00e9crit, dans un courriel destin\u00e9 \u00e0 d\u2019autres \u00e9lus, qu\u2019elle allait <\/span><span style=\"font-size: medium;\"><i>porter plainte contre Foucault, pour lui mettre un peu de plomb dans la t\u00eate<\/i><\/span><span style=\"font-size: medium;\">. Votre serviteur, ne sachant au d\u00e9part comment interpr\u00e9ter cette menace, \u00e9tait rest\u00e9 calme et avait attendu ce d\u00e9p\u00f4t de plainte avec s\u00e9r\u00e9nit\u00e9. Il n\u2019a jamais re\u00e7u aucune citation. <\/span><\/p>\n<p style=\"text-align: justify;\">Le 27 ao\u00fbt 2020, CC avait publi\u00e9 un article intitul\u00e9&nbsp;: <a href=\"https:\/\/contrib.city\/index.php\/2020\/08\/27\/m-h-aubert-declarait-seulement-484-e-de-remunerations-en-2015-a-la-hatvp\/\" target=\"_blank\" rel=\"noopener\">M.H Aubert, conseill\u00e8re d\u00e9partementale des Yvelines, d\u00e9clarait seulement 484\u20ac\/mois \u00e0 la HATVP.<\/a><\/p>\n<p style=\"text-align: justify;\">Le 12 octobre 2020, le conseil municipal de Jouy-en-Josas, sous la pr\u00e9sidence de son maire, se r\u00e9unissait et accusait nomm\u00e9ment Contrib\u2019City d\u2019avoir publi\u00e9 des informations <i>\u00e0 caract\u00e8re diffamatoire, calomnieux et outrageant<\/i>.<\/p>\n<p class=\"western\" align=\"justify\">Contrib\u2019City, site priv\u00e9 et ind\u00e9pendant, attaqu\u00e9 en pleine r\u00e9union d\u2019\u00e9lus, donc sans pouvoir se d\u00e9fendre, s\u2019\u00e9tait retrouv\u00e9 contraint de porter plainte pour diffamation. CC souhaitait initialement lancer cette proc\u00e9dure contre le Conseil municipal, mais son avocat, Me Liger, p\u00e9naliste versaillais dot\u00e9 d\u2019une longue carri\u00e8re, l\u2019avait inform\u00e9 que le Conseil municipal n\u2019\u00e9tant pas une personne morale, on ne pouvait lancer cette plainte contre cet organe municipal. Le recours \u00e9tait de citer directement la mairie, seule institution \u00e0 pouvoir \u00eatre convoqu\u00e9e en Justice pour toute affaire municipale, et repr\u00e9sent\u00e9e par son maire. Devant cet \u00e9l\u00e9ment de droit, CC avait donc port\u00e9 plainte uniquement contre Mme le maire, d\u2019autant plus que cette derni\u00e8re \u00e9tait intervenue deux fois lors du d\u00e9bat la concernant : la premi\u00e8re fois pour faire la police en mati\u00e8re de \u00ab timing \u00bb, la seconde pour dire que la Protection fonctionnelle pouvait \u00eatre demand\u00e9e <i>d\u00e8s qu\u2019il y [avait] outrage<\/i> (cf : bande-son de la d\u00e9lib\u00e9ration n\u00b08 du <a href=\"https:\/\/contrib.city\/index.php\/2020\/10\/15\/m-h-aubert-je-vais-porter-plainte-contre-foucault-pour-lui-mettre-du-plomb-dans-la-tete\/\" target=\"_blank\" rel=\"noopener\">Conseil Municipal du 12 octobre 2020<\/a>. 11&#8217;52&#8221; et 13&#8217;21&#8221;). Enfin, la synth\u00e8se \u00e9crite du Conseil municipal du 12 octobre, reprenait les accusations de publication d\u2019informations <i>\u00e0 caract\u00e8re diffamatoire, calomnieux et outrageant<\/i> et portait bien la signature de Marie-H\u00e9l\u00e8ne Aubert et le tampon de la mairie de Jouy-en-Josas.<\/p>\n<p style=\"text-align: justify;\">Le 18 octobre 2021, le Tribunal de 1\u00e8re instance, dans un <a href=\"https:\/\/contrib.city\/index.php\/2021\/11\/16\/jugement-de-salomon\/\" target=\"_blank\" rel=\"noopener\">jugement de Salomon<\/a>, avait \u00e9crit que Contrib\u2019City aurait d\u00fb porter plainte non pas contre Mme le Maire mais contre le Conseil municipal et d\u00e9boutait les deux parties de leurs demandes respectives.<\/p>\n<p style=\"text-align: justify;\">Sur les fortes recommandations de Me Liger, CC avait donc d\u00e9cid\u00e9 de faire appel, puisqu\u2019il n\u2019\u00e9tait pas juridiquement possible de porter plainte contre un organe qui n\u2019a pas de personnalit\u00e9 morale. Mais souhaitant disposer d\u2019un autre regard, le site avait fait appel \u00e0 Me Mandicas, p\u00e9naliste \u00e9galement et, par ailleurs, b\u00e2tonnier de Versailles. Ce dernier avait confirm\u00e9 les analyses de son confr\u00e8re et avait ainsi soulev\u00e9 une erreur de droit de la part du Tribunal de premi\u00e8re instance : le Conseil municipal n\u2019est pas une personnalit\u00e9 morale et l\u2019on ne peut donc pas porter plainte contre lui.<\/p>\n<p style=\"text-align: justify;\">Le 20 septembre 2022, la Cour d\u2019appel, comme dit plus haut, a renvoy\u00e9 les deux parties dos-\u00e0-dos. Elle a statu\u00e9 que Mme Aubert pouvait effectivement demander la Protection fonctionnelle via le Conseil municipal et qu\u2019elle <i>[n\u2019avait] pas pris part au [\u2026] au d\u00e9bat<\/i> pr\u00e9alable au vote. Et de conclure&nbsp;: <i>Mme Marie-H\u00e9l\u00e8ne Dumas \u00e9pouse Aubert ne saurait \u00eatre ainsi consid\u00e9r\u00e9e comme l\u2019auteure des propos poursuivis par la soci\u00e9t\u00e9 Contrib\u2019City comme \u00e9tant diffamatoires<\/i>.<\/p>\n<p style=\"text-align: justify;\">Cependant, cette conclusion am\u00e8ne deux remarques et une question juridique : tout d\u2019abord la double intervention de Marie-H\u00e9l\u00e8ne Aubert (et donc sa pr\u00e9sence physique) lors du d\u00e9bat a \u00e9t\u00e9 prouv\u00e9e (cf : extraits de la <a href=\"https:\/\/contrib.city\/wp-content\/uploads\/2022\/10\/Retranscription-CM-du-12-10-2020-art-CC-2022-10-14-1.pdf\" target=\"_blank\" rel=\"noopener\">retranscription CM du 12 10 2020<\/a>); ensuite, ni en premi\u00e8re instance, ni en seconde, le Tribunal n\u2019a remis en question l\u2019article de CC dat\u00e9 du 27 ao\u00fbt 2020 ou aucun autre.
